The Surgery Center at Mt. Zion Wins Certificate of Need Court Ruling
ATLANTA (July 2, 2008) – The Surgery Center at Mt. Zion, providing outpatient surgery services and pain management care in Atlanta since 1997, received a positive ruling last week when a Fulton County Superior Court judge, Judge Craig L. Schwall, Sr., denied Henry Medical Center's Petition for Judicial Review of the Surgery Center's relocation to a new facility at Spivey Station in Jonesboro, Ga.
Judge Schwall affirmed three earlier administrative decisions granting certificate of need approval for the Surgery Center's move, a step the State of Georgia requires for most new or replacement medical facilities.
Judge Schwall also ordered Henry Medical Center to pay the Surgery Center at Mt. Zion's attorneys' fees, finding that Henry Medical Center's petition lacked substanial justification and was undertaken solely for the purposes of delay.
The Surgery Center relocation from Morrow, Ga. to Spivey Station, a 90-acre medical campus now under development, will bring unparalleled outpatient service to the Southern Crescent. The new facility includes 25,000 square feet, operating rooms with telesurgery capability, a patient waiting area with business office tools and Internet cafe, and the ability to fill prescriptions prior to discharge. This will be the first time many of these amentities are offered in the Southern Crescent.
The Surgery Center at Mt. Zion has continually proven itself to be a top provider of health care services. Since 2000, they have maintained both a 98 percent patient satisfaction rate and a zero percent infection rate. With the move to Spivey Station in 2009, the Center will take a new name - Spivey Station Surgery Center.
